Provider Processing, Inc. DBA Contactless Payments & Contactless Payment Processing

1. Scope of Services
Provider Processing, Inc. (“Company,” “we,” “our,” or “us”) operates as a payment processing broker under the DBAs Contactless Payments and Contactless Payment Processing. We facilitate merchant account setups, assist with PCI compliance, and offer consulting related to payment processing solutions. Our partnerships include multiple payment gateways such as NMI, PayJunction, and CardConnect, and we work with various acquiring banks and processors.
We do not directly process transactions or assume liability for processor-related decisions, chargebacks, fraud, or security issues beyond our direct services.
2. No Guarantee of Merchant Account Approval
Merchant account approvals are subject to underwriting by the acquiring bank or processor. We do not guarantee approvals, specific processing rates, or processor terms.
3. $500 Cost Savings Guarantee
We guarantee that we can lower a merchant’s processing fees (excluding gateway fees, equipment costs, and chargebacks). This offer is only available to new customers and excludes existing or previously onboarded merchants, as we have already optimized their pricing.
Eligibility:
- Merchant must process at least $25,000 per month in Visa, MasterCard and Discover card transactions.
- Merchant must provide two (2) recent, original, unaltered statements from their current processor via email to [email protected] or [email protected] or secure upload at https://contactlesspaymentprocessing.com/secure-upload/.
- Claim must be submitted within 15 days of receiving a cost savings analysis.
- The guarantee applies only to processing costs, excluding gateway fees, software costs, or other expenses.
- The $500 will be issued as a check or a gift card of the merchant’s choosing.
Claim Process:
- Merchants must submit a request via email to [email protected] with their unaltered, complete processing statements for review.
- If any statements submitted are found to be altered or misrepresented, the guarantee is void.
4. Limitation of Liability
We are not liable for any losses, fees, or penalties resulting from processor decisions, chargebacks, fraud, or regulatory actions. Our role is limited to brokering payment processing services, and we do not assume financial responsibility for any merchant-related activities.
5. Merchant Responsibilities
- Merchants must comply with all applicable laws, card brand regulations, and processor requirements.
- Misrepresentation of business type, transaction volume, or financial standing may result in account termination by the processor.
- Merchants are responsible for all chargebacks, fees, and penalties associated with their account.
6. Termination of Services
We reserve the right to terminate services at our discretion for any reason, including but not limited to:
- Failure to comply with industry regulations or processor rules.
- Involvement in fraudulent or prohibited activities.
- Any action that could damage our reputation or relationships with processors.
Merchants may also cancel their accounts at any time, either through us or directly with their processor. If there is a support or cost-related concern, we will attempt to resolve it before completing the cancellation process.
7. Privacy & Data Security
- All merchant data is collected securely through AWS and stored in a protected environment (OneDrive, secured device).
- We do not sell or share merchant data with third parties.
- Security measures include regular malware scans, password-protected access, and automatic device locking.

8. Governing Law & Dispute Resolution
- This agreement is governed by the laws of the State of Nevada.
- Any disputes shall be resolved through binding arbitration in Clark County, Nevada.
- Merchants agree to waive the right to class-action lawsuits.
9. Indemnification
Merchants agree to indemnify and hold harmless Provider Processing, Inc., its officers, employees, and affiliates from any claims, damages, losses, or expenses arising from:
- Violation of card network rules or processor agreements.
- Chargebacks, fraud, or regulatory penalties.
- Misrepresentation of business activities.
10. Force Majeure
We shall not be held liable for delays or failures caused by events beyond our control, including but not limited to natural disasters, system outages, regulatory changes, or processor disruptions.
11. Retroactive Application
These Terms & Conditions apply to all merchants regardless of when they signed up or canceled their account. By continuing to use our services or maintaining an account with a processor onboarded through us, merchants acknowledge and agree to these terms. Any prior agreements are superseded by these updated Terms & Conditions.
